Welcome to AppAcquire. These terms govern your use of our platform and services. By using our website, you agree to be bound by these terms.
You must be at least 18 years old to use our services. You are responsible for ensuring that all information you provide is accurate and up-to-date. You must not use our platform for any illegal or unauthorized purpose.
When listing an app, you represent that you have the legal right to sell it and that all information provided is accurate. You are responsible for any claims, damages, or expenses arising from your listing.
We provide a platform for connecting buyers and sellers, but we are not a party to any transaction. All transactions are between the buyer and seller directly. We do not guarantee the accuracy of any listing or the performance of any app.
Escrow deals and fees
Buyers and sellers can complete a sale through AppAcquire using Escrow.com, an independent escrow provider. AppAcquire never holds your money: the buyer pays into escrow at Escrow.com, and Escrow.com releases the funds to the seller once the buyer accepts the app, under Escrow.com's own terms and rules, which you must also accept to use it.
AppAcquire charges a platform fee of 1.5% of the purchase price to the buyer and 1.5% of the purchase price to the seller. The fee is collected through Escrow.com when the transaction completes, in addition to Escrow.com's own fee, which is split equally between buyer and seller. No AppAcquire fee is due if the Escrow.com transaction is cancelled or does not complete. There is no charge to list an app or to make an offer.
If you are introduced to another user through AppAcquire, you agree to complete any sale between you through AppAcquire's escrow flow. Completing a sale outside it to avoid the platform fee is a breach of these terms, and we may suspend the accounts involved. You also agree to pay AppAcquire's fee as set out above and that Escrow.com may collect it on our behalf.
The offer, letter of intent, non-disclosure and asset purchase agreement templates on AppAcquire are provided for convenience. They are agreements between the buyer and the seller only. AppAcquire is not a party to them, is not a law firm and does not give legal, tax or financial advice, and you may wish to have a lawyer review them before you sign. You agree that typing your name signs them electronically and that the signature is binding. If a buyer and seller disagree, Escrow.com's dispute process decides what happens to the money held in escrow. We may help the parties, but we are not obliged to, and we are not responsible for the outcome or for the condition of any app that is transferred.
We reserve the right to remove any listing or suspend any account that violates these terms. We may also modify or discontinue our services at any time without notice.
Our services are provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of our platform, including but not limited to direct, indirect, incidental, or consequential damages.
These terms are governed by the laws of the jurisdiction in which AppAcquire operates. Any disputes will be resolved through binding arbitration.
